Terms and conditions

Please read these Terms and Conditions carefully before using the WinBoss Services and make sure that you fully understand their content. These Terms and Conditions, together with the Privacy Policy and the Game Rules, constitute a binding agreement (“Agreement”) between the User and WinBoss.
By registering an account on www.winboss.ro, you confirm that you have read and understood these Terms and Conditions, the Privacy Policy, and the Game Rules and accept that they will apply to you.
If the user does not agree with these Terms and Conditions, the Privacy Policy, or the Game Rules, they must immediately stop using our Services.
If you have doubts regarding your rights and obligations under this Agreement, you may seek the advice of a lawyer or a specialist in your jurisdiction. It is essential to know the laws of your jurisdiction before registering and using our websites or any other Service. Some gambling games are restricted by law in some states and may be indefinitely prohibited by law in others. WinBoss cannot be held responsible for any problem encountered by the User in matters of jurisdiction.
To be close to players and respond promptly to their questions, WinBoss has created the “Frequently Asked Questions (FAQ)” section. This section can be accessed from the “About Us” menu and contains answers to the most common questions a player may face. It is the player’s obligation to access and acknowledge the information included in the “Frequently Asked Questions” section.
Participation in any gambling game implies the unconditional acceptance of the Terms and Conditions and the Game Rules according to Romanian Law.

The provisions contained in these Terms and Conditions, as updated or amended periodically, represent the contract concluded between you and Crowd Entertainment Ltd., a company incorporated under Maltese law, with registered office at Spinola Road, St. Julians STJ 3014, Malta, registered under number C97517, and Unique Tax Identification Code 43557448. Crowd Entertainment Ltd operates under the remote gambling license no. L1213823W001269 and the exploitation authorizations issued by the Romanian National Gambling Office.
These Terms and Conditions, together with the Privacy Policy, the Responsible Gambling Policy, and any other policies and/or regulations regarding the Services, constitute a binding agreement (“Agreement”) between you, as User, and Crowd Entertainment Ltd.
Hereinafter, any reference to “we,” “our,” “the website,” or “Crowd Entertainment Ltd” refers to the company Crowd Entertainment Ltd.
Before using the services provided by us, please read carefully the provisions below and make sure you fully understand their content and agree to the unconditional conclusion of the contract between you and Crowd Entertainment Ltd. You will not be able to use the Services if you do not agree with any of the provisions contained in these Terms and Conditions

1. Right to use the services

1.1 Crowd Entertainment Ltd grants the User the right to access the platform and participate in the online gambling games available through www.winboss.ro (“Services”). The right to access the WinBoss platform is: non-exclusive, personal, non-transferable, non-sublicensable, and revocable.

1.2 We grant you permission to access the Services for personal use only. Please note that the use of the Services is prohibited to:

a) persons under 18 years of age;

b) persons who are considered minors according to the applicable laws in their country of residence;

c) persons who lack legal capacity or have restricted legal capacity;

d) persons accessing the Services in jurisdictions where participation in gambling is prohibited by law. Crowd Entertainment Ltd assumes no responsibility and does not verify the legality of the Services in the jurisdiction from which a player connects or accesses the Services. Thus, it is the sole responsibility of the User to ensure that access to the Services is permitted in their jurisdiction.

1.3 We reserve the right to request at any time that you provide personal data and documents proving compliance with the conditions for using the Services (for example, a copy of your identity card or passport, proof of residence or domicile, your national identification number, your email address, your credit card details or other payment methods, etc.). Crowd Entertainment Ltd reserves the right to suspend or permanently block your access to the Services if you do not provide sufficient proof regarding compliance with the conditions for using the Services, or if we have reasonable suspicions that the information provided is untrue, incomplete, and up to date, the User using the Services by deceitful practices. We also reserve the right to suspend or cancel a withdrawal if further checks are required regarding the above.

1.4 If at any time during the use of the Services it is discovered or there are reasonable suspicions from Crowd Entertainment Ltd that an account is owned or used by a minor (a person under 18 years of age or who, depending on the applicable jurisdiction, is considered a minor), the account will be closed immediately. Undecided Bets/Wagers will be considered void or canceled, and the amounts deposited in the User’s account will be retained.

1.5 Crowd Entertainment Ltd and its providers (including any Third-Party Providers) are the sole holders of all rights over the software programs used to provide the Services including, but not limited to, any source code, copyrights, trade secrets, as well as any other intellectual property rights related to the Services. The User is prohibited, in accordance with applicable law:

a) to copy, distribute, publish, reverse engineer (disassembling or breaking down the website/mobile app for the purpose of creating other similar models), decompile, disassemble, modify, translate the website/mobile app or attempt to access the source code to create other products using the source code of the website/mobile app, etc.;

b) to collect content available on the Crowd Entertainment Ltd internet pages through data collection techniques known as “scraping,” “harvesting,” or “data extraction”;

c) to sell, assign, sublicense, transfer, distribute, or rent the website/mobile app;

d) to make the website/mobile app available to any third party through a computer network or otherwise;

e) to export the website/mobile app to any country (whether by physical or electronic means); or

f) to use the website/mobile app in a manner prohibited by applicable laws or by the regulations or policies of Crowd Entertainment Ltd;

(the above cases represent “Improper Use”).

Crowd Entertainment Ltd reserves all rights not expressly or implicitly granted to the User under this agreement and retains all rights, titles, and interests over the website/mobile app or any other intellectual property rights related to the Services.

You agree that you will be solely responsible for any damages, costs, or expenses arising from or in connection with your commission of any Improper Use. You are obliged to notify Crowd Entertainment Ltd immediately upon becoming aware of any Improper Use by any person and will provide us support, together with all the information you have, in any investigation we may carry out based on your report.

1.6 The name “Crowd Entertainment Ltd,” the domain name “Winboss.ro” and any other trademarks, service marks, logos, trade names, and/or domain names used by Crowd Entertainment Ltd on its internet pages and/or incorporated into the website/mobile app or occasionally used in all these media (hereinafter referred to as “Trademarks”) belong to Crowd Entertainment Ltd and/or its group companies and/or its providers, and these entities reserve all rights to these Trademarks. In addition, all content on the website and the mobile app, images, graphics, photographs, animations, videos, music, sound, and text belong to Crowd Entertainment Ltd and/or its group companies and/or its providers (including any Third-Party Providers) and are protected by copyright law and/or intellectual property law and other related rights. By accepting the Terms and Conditions, you declare that, by using the Services, you do not acquire any rights over the content available on the internet pages and/or the Trademarks, or over any part incorporated in them. Under no circumstances may you use the content available on the internet pages and/or the Trademarks without the prior written consent of Crowd Entertainment Ltd. In addition, you agree not to do anything that damages or could damage the rights, including intellectual property rights, owned by Crowd Entertainment Ltd, its group companies, and/or its providers (including third-party providers).

1.7 By accepting the Terms and Conditions, you declare that any name, title, or image used by you in connection with the Services (for example, your username) does not infringe copyrights or any other intellectual property rights, confidentiality, or any other rights of a third party. By accepting the Terms and Conditions, you grant Crowd Entertainment Ltd permission to use any names, titles, and images, subject to the provisions of our Privacy Policy. This right may extend internationally, is irrevocable, transferable, and free of charge.

1.8 Crowd Entertainment Ltd reserves any rights regarding the creation, maintenance, and closure of user accounts registered on its internet pages. The decision of Crowd Entertainment Ltd’s management, regarding any aspect of a user’s account, the use of the Services, or the resolution of any disputes, is final.

1.9 The gaming account created by a User will hereinafter be referred to as the Account. All references in these Terms and Conditions to “user account” or “account” are references to your gaming account registered on the www.winboss.ro internet page or, as the case may be, on mobile applications associated with the www.winboss.ro domain.

2. Warranties

2.1 The Services of Crowd Entertainment Ltd are provided to you “as is” and Crowd Entertainment Ltd hereby disclaims any and all warranties or representations, express or implied, related to the Services provided, except those provided by the applicable legal regulations.

2.2 Regardless of our efforts to provide you with the highest quality services, the Services may be interrupted or not provided on time, and there may be delays or errors. It is your responsibility to protect your system from all computer viruses, and Crowd Entertainment Ltd shall in no case be held liable for any losses suffered due to or in connection with any virus. If there are viruses or technical errors in our systems, we reserve the right to suspend the services.

2.3 Crowd Entertainment Ltd reserves the right to suspend, interrupt, modify, remove, or add any component of the Services, with immediate effect and without obligation to send prior notice:

a) if we notice that the player uses the WinBoss platform for purposes other than those for which it was designed (entertainment);

b) for the maintenance of any software incorporated into the Services. During this process, in the event of a potential win resulting from a placed bet, it will not be validated, and the stake will be returned to the player’s account.

2.4 Crowd Entertainment Ltd cannot be held liable for any interruption or other incidents during the use of the Services, if these are due to any type of deficiency of the telecommunications networks and the Internet access service you use.

2.5 Crowd Entertainment Ltd may initiate maintenance or updates of any software incorporated into the Services and we will not be liable in any way for any loss suffered as a result of any decision made by Crowd Entertainment Ltd in this regard.

2.6 Before using the Services and throughout their use, you declare and agree that:

a) the use of the Services involves a financial risk and you are fully and solely responsible for any losses suffered when using the Services;

b) Crowd Entertainment Ltd is not a financial institution, therefore the money deposited in the Account does not bear interest or any other accessories;

c) your use of the Services is your choice and you are solely responsible to act in accordance with the applicable legislation, as well as with this Agreement;

d) in accordance with our regulatory requirements and in order to access and use the website/mobile app and/or our Services, through www.winboss.ro, you will need to provide us with certain personal data (including details about your payment methods), as well as consent regarding the access or use of your location data and/or other data or information that may be obtained from your device/computer, in order to enable the website/mobile app to be made available to you. You hereby give consent to the access and use of such data for the purposes described above. Without such consent, the Services are unavailable. Crowd Entertainment Ltd will process your personal data in accordance with our Privacy Policy;

e) Crowd Entertainment Ltd does not provide Users with advice on tax and/or legal matters. Users who wish to obtain advice on tax and/or legal matters are advised to contact authorized persons and/or the appropriate authorities in their jurisdiction of domicile and/or residence;

f) the telecommunications networks and Internet access services you use to access are outside the Organizer’s control, and Crowd Entertainment Ltd shall have no liability for any interruptions or malfunctions affecting them; and

g) you are 18 years of age or older;

h) the information, documents, and data provided for the use of the Services are true, complete, and up to date and you further agree to update this information, as necessary, to keep it true, complete, and up to date.

3. Prohibited uses of the services

3.1 MODIFICATIONS OF THE WEBSITE/MOBILE APP. The User is prohibited from any action by which they would attempt to modify, decompile, reverse engineer, or disassemble the website/mobile app in any way.

3.2 USE BY THIRD PARTIES. The Services are intended solely for the personal use of the User. The User may use the Services for entertainment purposes and only for personal interest, without allowing others access to the gaming Account. Under no circumstances will a User be allowed to use the Account for any purpose other than to use the Services. The User must provide complete and truthful information regarding all details and information provided to Crowd Entertainment Ltd, and the User is obliged to update this information whenever any change occurs.

3.3 FRAUDULENT AGREEMENTS (agreement between two or more users to obtain undue benefits). Crowd Entertainment Ltd reserves the right to restrict or block Users’ access to the Services or to adopt any other necessary measures if there are reasonable suspicions that they are part of a fraudulent agreement. In addition, Crowd Entertainment Ltd reserves the right to consider any fraudulent agreement or attempted such actions between Users as a serious violation of this agreement and, therefore, Crowd Entertainment Ltd shall have the right to close the Account in such case.

3.4 EXTERNAL ASSISTANCE DEVICES AND FACILITIES FOR PARTICIPATION IN THE GAME. Crowd Entertainment Ltd prohibits the use of any tools designed to alter the Services in any way and to provide any “unfair advantage” to one User over another User in the same conditions. Crowd Entertainment Ltd defines external assistance devices and facilities for participation in the game as any mechanical or electronic devices, software programs, and systems (other than those built into the Services) intended to alter elements of chance, methods of determining game outcomes, or the amount or frequency of payment within a gambling game (“Prohibited Devices”). Crowd Entertainment Ltd has a broad view of what constitutes an “unfair advantage” in the context of any use of Prohibited Devices.

3.5 AUTOMATED USERS (BOTS). The use of artificial intelligence, including but not limited to the use of robots, is strictly prohibited. All actions taken by a User in connection with the Services must be executed personally by them through www.winboss.ro or, as the case may be, through associated mobile applications.

3.6 You agree that Crowd Entertainment Ltd may take measures to detect and prevent the use of Prohibited Devices.

3.7 FRAUDULENT ACTIVITIES. If there are reasonable suspicions that a User has engaged or attempted to engage in fraudulent, illegal, illicit, or improper activities during the use of the Services, including but not limited to engaging in any of the activities provided in this clause or any other action intended to alter participation in the game, or making a fraudulent payment using a stolen credit card or attempting to disguise the source of funds, Crowd Entertainment Ltd shall have the right to take the measures it deems necessary, including but not limited to:

a) immediately blocking a User’s access to the Services;

b) closing the Account;

c) retaining the funds in the Account;

d) disclosing information (including regarding the User’s identity) to financial institutions, relevant authorities, and/or any person or entity that presents a legal basis for the disclosure of such information;

e) taking any measures against a User, according to applicable law.

3.8 GAMING PLATFORM. You will not abuse or take advantage of any error or technical incidents of Crowd Entertainment Limited’s Services. You will not disclose any information regarding an error or technical incident related to Crowd Entertainment Limited’s Services. If you exploit or disclose any information about an error or incident, the Company reserves the right to take any measures to remedy the damage caused.

3.9 To maintain fair play on our website, it is prohibited to use suspicious or recognized betting techniques or patterns to circumvent the usual advantage offered by our games. If there is reasonable suspicion that the account holder has used or attempted to use such techniques or betting patterns, Crowd Entertainment Ltd has the right to impose betting limits on the gaming account, refuse certain bets, or immediately close the gaming account and retain the amounts existing in the Account balance.

3.10 ERRORS AND TECHNICAL MALFUNCTIONS. In the event of any errors or technical malfunctions of the software products included in the Services offered by Crowd Entertainment Ltd, all games and game rounds will be declared void. If the gaming Account has been credited with amounts representing winnings resulting from such an error, that amount remains the property of Crowd Entertainment Ltd and will be canceled from the Account. If the error is identified after the User has withdrawn the amounts from the gaming Account, the amount paid to the User will be refunded at the request of Crowd Entertainment Ltd.

4. Withdrawal of funds

4.1 Withdrawal of funds from the Account may be carried out in accordance with applicable legislation and our internal procedures.

4.2 Crowd Entertainment Ltd reserves the right to use additional eligibility criteria to determine the withdrawal options that may be offered to Users at any given time or for the prior authorization of such operations. You understand and agree that some deposits or withdrawals may take longer if additional checks are required in accordance with anti-money laundering and counter-terrorist financing policies and/or the company’s internal procedures before processing withdrawals or deposits. You also understand and agree that in such cases we may suspend or cancel a withdrawal. If any of these measures are imposed, Crowd Entertainment Ltd reserves the right to suspend the withdrawal functionality until the checks are completed.

We also reserve the right to suspend the gaming account during the entire verification period, without prior notice.

4.3 Crowd Entertainment Ltd may apply deposit or withdrawal limits following specific checks carried out on the Account or depending on the payment method chosen for processing a transaction.

4.4 Crowd Entertainment Ltd has no responsibility regarding the accuracy of the payment details provided by you. You are fully responsible for any losses, damages, expenses, and costs incurred as a result of any erroneous payments.

4.5 If you use a payment method associated with a bank account that does not belong to you or use funds that do not belong to you – including a stolen, cloned, or unauthorized payment method – we reserve the right to consider that deposit invalid, and any winnings obtained from that deposit null and void, until all necessary checks are satisfactorily completed.

4.6 Each deposit, regardless of the amount, must be rolled over at least once to be eligible for withdrawal. Regarding “Bonus” funds, please consult the terms and conditions applicable to each Bonus.

5. Offensive language or content

4.1. В5.1 When using the chat function, if such a function is available, the User is prohibited from posting materials that incorporate illegal, indecent, racist, obscene, defamatory, slanderous, or threatening elements/content, or any material that would violate any law or that, in general, could be considered offensive or licentious.

6. Breaches of terms and conditions

6.1 Without prejudice to any other rights provided under this agreement, if a User breaches, in whole or in part, any of the obligations set out in these Terms and Conditions, including but not limited to the cases below:

a) a User has more than one active gaming account;

b) a User provides incomplete, incorrect, or untrue information to Crowd Entertainment Ltd during the registration process or at any time during the KYC process;

c) the User refuses or cannot confirm/validate information regarding the gaming account and the activity carried out on the account at any time during the KYC process;

d) the User is not of legal age to use the Services;

e) the User resides in a jurisdiction where the use of the Services is prohibited by law;

f) the User allows (intentionally or negligently) a third party to use the Account;

g) the User requests a chargeback or cancels any payment made in connection with the Services or uses fraudulent payment methods;

h) the User alters participation in the game in any way or attempts to obtain undue benefits through fraudulent methods;

i) the User uses www.winboss.ro, the Services, or the Account in bad faith, for purposes other than those for which it was registered;

j) the User abuses promotions offered by Crowd Entertainment Ltd or promotions offered by our partners or in any way abuses our services;

k) the User violates Clause 5, making licentious, defamatory, or offensive statements within the chat service; or

l) the User breaches any of the warranties or representations set out in Clause 4 above.

By simply failing to perform or breaching the above obligations, the User is automatically in default.

Crowd Entertainment Ltd reserves the right, at its discretion, to take any measures it deems necessary, including terminating this agreement or any other related agreement concluded with the User, suspending or blocking a withdrawal initiated by the User, immediately blocking the User’s access to the Account and any other Services provided by Crowd Entertainment Ltd, closing the Account, retaining as a penalty clause all sums of money in the Account, and taking any other measures against the User concerned, in accordance with applicable law.

Termination of the Agreement shall occur by law on the date the User is notified, without further formalities.

6.2 You agree to fully indemnify, defend, and hold harmless Crowd Entertainment Ltd against all claims, demands, damages, losses, costs, and expenses, including legal fees and any other charges, regardless of how they were caused, which may result from:

a) your breach of this agreement, in whole or in part;

b) your breach of any applicable law;

c) the use of the Account by a third party with or without your approval.

7. Limitation of liability

7.1 Except as otherwise provided in this Agreement, Crowd Entertainment Ltd together with its providers (including any Third-Party Providers) are exempt from liability, including in cases of gross negligence, for any punitive, compensatory, consequential, special, direct, or indirect damages (including but not limited to damages relating to loss of profits) arising from the use (or misuse) of the Services, even if Crowd Entertainment Ltd might have been aware of the possibility of such damages occurring.

7.2 Nothing in this agreement excludes or limits Crowd Entertainment Ltd’s liability for:

a) death or personal injury resulting from its fault; or

b) fraud or fraudulent misrepresentation.

8. Security and winboss account

8.1 A User may have only one gaming account registered on the gaming platform available through www.winboss.ro and will use the Services only through this unique account. It is prohibited for a user to open multiple gaming accounts on www.winboss.ro. If Crowd Entertainment Ltd becomes aware of additional accounts opened by a User, Crowd Entertainment Ltd may close those additional accounts without prior notice and may retain the funds held in those accounts. This measure does not implicitly mean the closure of the main gaming account, the decision remaining at the discretion of Crowd Entertainment Ltd depending on any damages caused.

8.2 The Account will be accessible through the use of credentials consisting of:

a) Username (“User ID”) and/or Email Address (“Email”) and/or Nickname depending on the website/mobile app settings;

b) A unique and secret password (“Password”);

c) other optional numeric authentication methods that may be made available by Crowd Entertainment Ltd for Account authentication,

together referred to as “Authentication Credentials.”

The User is obliged to use the Authentication Credentials in accordance with the rules communicated by Crowd Entertainment Ltd. In addition, the User must provide the information we request in our registration form, such as (but not limited to) full name, residence address, valid email address, personal identification number (CNP for Romanian citizens), and an express confirmation that the User is over 18 years old and accepts in full the Privacy Policy together with the Terms and Conditions. Please note that we may verify, with the help of appropriate checks carried out by third-party service providers if necessary, the identity and residence address of all persons wishing to register an Account on winboss.ro. You agree to provide only truthful, complete, and up-to-date information and also agree to update this information appropriately to keep it truthful and complete.

8.3 The User agrees that they are solely responsible for the use of the Services through their Authentication Credentials and that they will not disclose the Authentication Credentials to anyone nor allow any other person to use the Services through the Account.

8.4 The User is obliged to always keep the Authentication Credentials secret and confidential and to make every effort to protect their secrecy and confidentiality. The User will be held liable for any unauthorized use of the Services through the Authentication Credentials.

8.5 It is your obligation to ensure that all information included in the registration form provided to Crowd Entertainment Ltd is truthful, accurate, complete, and matches the names on the bank cards used for deposits and withdrawals. We reserve the right to close any Account created on winboss.ro if the information provided to Crowd Entertainment Ltd proves to be false, inaccurate, incorrect, or incomplete. It is the User’s responsibility to inform us of any changes to the information provided as soon as possible.

8.6 UPDATING PAYMENT METHODS. Updating or adding payment methods can be done through the website/mobile app. It is your responsibility to inform yourself about the conditions under which your payments are accepted. You are solely responsible for becoming aware of any updates regarding payment methods. Depending on the payment processor used, please note that sometimes a payment method used cannot be deleted from your account.

8.7 WINBOSS ACCOUNT ACTIVATION. All Users will receive an email and/or SMS at the email address/phone number entered in the registration form for Account activation. If the activation process is not completed, Crowd Entertainment Ltd reserves the right to suspend all activities in that account until the information provided by the User is verified. Until we verify the authenticity of the data provided during registration, the User may not deposit more than 200 Euros or the equivalent in RON (single or cumulative deposits) or make a withdrawal from the Account. To verify the identity, residence address of the User, or any other information regarding the player or payment methods, we may request supporting documents (including but not limited to a copy of the identity card, passport, a recent bank statement, proof from the card-issuing bank, and/or a utility bill). If the User does not provide the information or supporting documents requested under KYC measures within 30 calendar days from the date of their first deposit or if their name appears on the list of self-excluded or undesirable players, the user account will be closed, and the deposited amounts will be transferred to the state budget.

8.8 If you have not made any transaction in your User Account for a period of 1 (one) year, the Account will be classified as inactive. In this case, the positive balance in the Account will be credited to your bank account. If the bank account or other payment details are incorrect and we cannot transfer the funds, we will contact you to provide the bank details where the Organizer can make the payment. From that moment, you will have one year to provide valid payment details to allow the transfer of funds. If we receive no response from you at the expiration of this period, the funds will be remitted to the state budget.

8.9 You will not be able to place a bet with a stake greater than the total amount of real money in the Account.

8.10 You understand and agree that each amount deposited in the gaming account is subject to a minimum 1x wagering requirement to be eligible for withdrawal.

8.11 You are fully responsible for the payment of all amounts owed to Crowd Entertainment Ltd. You agree not to request a chargeback and/or to refuse or cancel any payment made by you in connection with the Services. You will indemnify Crowd Entertainment Ltd for any request for refund of funds (chargeback), refusal, or cancellation of a payment, as well as any loss suffered by us as a result. You agree that the amounts transferred to the Account constitute a penal deposit and may be retained by Crowd Entertainment Ltd in case of termination of the Agreement due to causes attributable to you.

8.12 Crowd Entertainment Ltd reserves the right to carry out checks regarding a User’s financial history and/or identity, with the help of third-party providers, using the information provided by the User during registration.

8.13 Crowd Entertainment Ltd reserves the right to use electronic payment processors and/or third-party financial institutions to process payments made by and to you in connection with the use of the Services.

8.14 Crowd Entertainment Ltd reserves the right to close the Account for any reason, at any time, and without notifying the respective User. If the Account is closed for reasons not attributable to the User (e.g., termination of the site’s activity), any existing balance in the Account at the time of closure will be credited to the User’s registered bank account. If this is not possible, we will inform you of this situation and ask you to provide a valid bank account. If you do not provide the necessary data within one year, the remaining balance in that account will be transferred to the state budget of Romania. When the closure of the Account is due to your breach of this Agreement or applicable law, Crowd Entertainment Ltd will retain the funds deposited in your Account.

8.15 A User may request the closure of the Account at any time through the form available in the Account, Chat, or email. Any closure or restriction of the Account requested through other means of communication may be confirmed via email, including if the closure was requested through the form in the Account. If Crowd Entertainment Ltd considers that it is not appropriate to reopen the Account, it will be permanently closed, at the sole discretion of Crowd Entertainment Ltd.

8.16 Users are strictly prohibited from using the Services to facilitate any illegal money transfer. You will not use the Services for illegal or fraudulent activities or prohibited transactions (including those attempting money laundering), in accordance with applicable law. If Crowd Entertainment Ltd suspects that you are engaged or have been engaged in fraudulent, illegal, or improper activities, including but not limited to money laundering, terrorist financing, or behavior that otherwise violates this agreement, your access to the Services will be immediately interrupted and/or the Account will be closed. If the Account is closed or blocked under such circumstances, Crowd Entertainment Ltd has no obligation to refund the funds in the Account balance. In addition, Crowd Entertainment Ltd has the right to inform the relevant authorities, other online service providers, and banks, payment service providers, or other financial institutions about your identity and any activity suspected of illegality or fraud, and you will fully cooperate with Crowd Entertainment Ltd to investigate any such activity.

8.17 A User may set Responsible Gaming measures in the dedicated section of their account.

8.18 IMPORTANT INFORMATION REGARDING TAXES OR OTHER FEES. Please note that, in accordance with Romanian legislation and regulations, we must withhold tax when processing your withdrawals. Please read “Information regarding taxes and levies – Frequently asked questions about withholding tax at source for players,” which provides more details about this process. Please note that you remain solely responsible for any other applicable taxes and levies that must be paid for in-kind or any type of prizes granted to you in promotional campaigns as a result of using the Services.

9. Components of services provided by third parties

9.1 The Services provided by Crowd Entertainment Ltd integrate software programs supplied by specialized software distributors that are the property of the providers and are subject to copyright law, including from other jurisdictions (“Licensed Programs”).

9.2 The User’s use of the Licensed Programs is conditioned on compliance with all the terms and conditions in this agreement.

9.3 The Licensed Programs may not be altered, modified, or extracted from the Services.

9.4 The User’s use is limited to “personal use,” i.e., only within the User’s ordinary personal and internal activity, and not for commercial activities.

9.5 All rights not expressly granted by this agreement are reserved.

10. Responsible gaming

10.1 To ensure the protection of players against the negative effects that gambling may have on participants and to promote a responsible gaming environment, we have committed to implementing strict safety measures, including self-exclusion facilities, deposit limits, and self-assessment tools. Details of these options can be found in the Responsible Gaming Policy.

10.2 The User may self-exclude from using the Services, a measure that restricts access to the gaming Account temporarily or permanently. As a result of self-exclusion, the User will be prevented from accessing any gaming account held by the User on websites operated by Crowd Entertainment Ltd for the duration of the self-exclusion period.

11. Disputes

11.1 The User accepts that the only valid data regarding gaming sessions will be those recorded on the servers of Crowd Entertainment Ltd (including any Third-Party Providers).

11.2 If you have any complaints related to the Services provided by Crowd Entertainment Ltd, you must contact customer service.

11.3 The resolution period for any petition / notification / complaint / request is 14 days from the date of its registration. If the resolution of the issue is unsatisfactory, you have the option to address the competent authorities: the National Gambling Office via http://onjn.gov.ro.

12. Amendment of terms and conditions

12.1 Crowd Entertainment Ltd își rezervă dreptul de a actualiza sau de a modifica acest acord sau orice parte a acestuia în orice moment, in conformitate cu legislatia aplicabila in domeniul jocurilor de noroc din Romania. Vă încurajăm să vizitați secțiunea Termeni și Condiții în mod regulat și să verificați versiunea actualizată a Acordului. Utilizarea în continuare a Serviciilor va fi considerată ca fiind o acceptare a acordului dumneavoastră cu privire la orice modificare a Acordului.

13. Governing law

13.1 The Agreement and any related matters shall be governed by and interpreted in accordance with the laws of Romania. Jurisdiction over the resolution of any dispute arising from this agreement shall be determined in accordance with Romanian legislation.

14. Partial nullity

14.1 If any provision of the Agreement is or becomes void, invalid, or otherwise unenforceable, the remaining provisions, as applicable, shall remain in full force and effect.

15. Assignment

15.1 Crowd Entertainment Ltd reserves the right to assign this agreement, in whole or in part, at any time and without prior notice. The User will subsequently be informed of such assignment through any available communication means, including the website. The User may not assign their rights or obligations, in whole or in part, under this agreement.

16. Miscellaneous

16.1 No waiver of any breach of any provision of the Agreement shall constitute a waiver of a previous, concurrent, or subsequent breach of the same provision or other provisions of this Agreement, and no waiver shall be effective unless expressly made in writing and signed by an authorized representative of any of the waiving parties.

16.2 No provision of this agreement creates or grants rights or other benefits in favor of third parties who are not parties to this agreement.

16.3 These Terms and Conditions constitute the contract between you and us regarding the Services and supersede any prior agreement, understanding, or contract concluded between you and us.

16.4 The User must provide complete and truthful information regarding all details and information requested by Crowd Entertainment Ltd in relation to the use of the Service by the User, subject to the terms of the Privacy Policy.

17. Bonus and promotions policy

17.1 Users may be eligible to participate in promotional campaigns during which they may benefit from the granting of bonuses or other prizes. The conditions, amounts, and granting of bonuses/prizes will be established by Crowd Entertainment Ltd and are not negotiable.

17.2 Once you choose to self-exclude, your account will be closed for the selected period, and you will no longer be able to log in to your account and/or access the Games. Please note that in the case of already scheduled marketing campaigns, some messages may still be automatically sent to you up to 48h after self-exclusion or limitation. However, you will not be able to access the gaming account and will not be eligible for any offer.

17.3 Each promotional campaign/bonus offer is subject to specific terms and conditions and the Special Terms regarding Bonuses and Promotional Campaigns, which contain all information regarding prizes or bonuses, such as: duration, validity, wagering requirements, activation requirements, restrictions, conversion limits, etc.

17.4 Each User undertakes to read the terms applicable to each bonus.

17.5 Crowd Entertainment Ltd reserves the right to cancel any bonus, special offer, or promotion at any time, in compliance with applicable legal provisions.

17.6 Unless otherwise specified, all bonuses offered by Crowd Entertainment Ltd are limited to one per User, IP address, home address.

17.7 If a withdrawal attempt is made from the Account (including the first deposit) before fulfilling the wagering requirements set out in the specific terms and conditions for each Bonus, Crowd Entertainment Ltd reserves the right to cancel any bonus in the Account, including winnings derived from the use of such bonus funds.

17.8 Any interrupted or abandoned game will result in the cancellation of bets placed within such a game. Canceled bets will not be counted toward the wagering requirements of bonuses.

17.9 Some bonuses are eligible only for certain deposit methods, which will be mentioned in the specific Terms and Conditions.

17.10 Crowd Entertainment Ltd reserves the right to cancel a bonus offer at any time in the event of abusive use by the player to the detriment of the Organizer. For Accounts benefiting from a bonus, the Player’s bets will first be placed using real money, then, after that amount has been used, bets may be placed using any bonus in the Account. If Crowd Entertainment Ltd grants a bonus in the Account as part of a promotion, the User may use the bonus amount only to place bets on winboss.ro and is not allowed to withdraw the amounts representing the bonus. Crowd Entertainment Ltd reserves the right to retain these amounts if the User does not use them to place one or more bets during the period specified in the promotion or according to the conditions specified in the promotion/campaign regulations.

17.11 Crowd Entertainment Ltd reserves the right to label a User as a "Bonus Seeker"/“Bonus Abuser” if Crowd Entertainment Ltd considers that such User has abused the promotions offered by Crowd Entertainment Ltd (including, but not limited to, the promotions of our partners), as well as any other type of abuse of our services.

17.12 Once Crowd Entertainment Ltd declares a User as a “Bonus Seeker,” that User will no longer be able to participate in promotional campaigns, with the Organizer retaining the discretion to block access to services.

17.13 Bonuses granted may be withdrawn only after the wagering requirements specific to each Bonus, stated in the specific Terms and Conditions of each Bonus, have been met, within the standard limit of 10,000 RON. Depending on the category of player you belong to, you may benefit from increased limits.

17.14 We reserve the right to check all Accounts involved in the campaign. If any irregularity or breach of this agreement or the campaign’s terms and conditions is suspected, Crowd Entertainment Ltd may request additional documents/information.

17.15 We reserve the right to disqualify from the campaign participants who cannot prove the authenticity of their information or who show abusive/fraudulent behavior, the decision to close the account(s) involved remaining at the discretion of Crowd Entertainment Ltd.

Abusive/fraudulent behavior may be considered any of the following, but not limited to:

a) Creating fictitious accounts;

b) Using identity documents without the consent of the holders for the purpose of registering a gaming account;

c) Manipulating or falsifying referral data;

d) Using automated solutions to register false referrals or to send mass invitations;

e) Offering external rewards as an incentive for registering accounts.
